Terms and conditions

Last updated: 7 November 2026

1. Purpose

CrushCode designs, publishes and hosts websites. These terms apply to every order placed on crushcode.fr: setting up a site, the subscription that keeps it running and the options. The seller is the publisher of crushcode.fr, presented in the legal notice; it can be reached at ccrushcode@gmail.com.

2. Customers

The service is open to consumers and to professionals. Some clauses apply only to one or the other; they say so. A consumer is any natural person acting for purposes outside their trade, business, craft or profession.

3. See before you pay

You send us the link to your Instagram account or your website. We prepare a first version of your site, which you look at for free, without a bank card. You only pay if you decide to keep it.

4. What your order includes

  • The setup, paid once when ordering, according to the option chosen on the offer page (“Generated from the form”, “Landing page finished by us”, “Brochure site, up to 8 pages”, or “Brochure site and editable blog”). If you take up a subscription again after stopping it, it is not charged a second time.
  • The subscription: hosting of the site, its security certificate (HTTPS), the administration area to edit your texts and images yourself, technical and security updates, and email support. The subscription does not include changes made by us.
  • The Serenity option, optional: up to 1 hour of changes a month made by us, handled within 48 business hours; time not used in a month does not carry over to the next.
  • Custom work, on quote.
  • The domain name offered with the yearly plan (article 10).

5. Prices and discount codes

Prices are those shown on the offer page at the time of ordering, in euros. A discount code is entered on the payment page: the launch code grants the announced discount for as long as the subscription stays active, within the announced number of places; a partner code grants the discount shown when it is entered.

6. Ordering and payment

Before paying, you accept these terms and conditions by ticking the box provided. After payment, we email you a confirmation of your order: it sets out what you bought, its price, the length of the subscription if any, the information on the right of withdrawal and, where applicable, your request for immediate performance.

Payment is made by card, through Stripe. The setup and the first subscription period are paid when ordering; each following period is charged automatically when it falls due.

7. Going live

After payment, we put your site online under your domain name and write to you as soon as it is done. If you already have a domain name, you give us the access needed to connect it to your site.

8. Your commitments

You are the publisher of your site and answer for its content. You give us accurate information, and you hold the rights to the texts, images, logos and trademarks you entrust to us. You give us the information needed for your site's legal notice and privacy policy.

9. Your site's visitor data (processing on your behalf, article 28 of the GDPR)

For the data of your site's visitors (form messages, orders from your shop), you are the controller and CrushCode is your processor. CrushCode:

  • processes this data only to run your site, on your instructions;
  • ensures its confidentiality and security, and binds the people who access it to the same confidentiality;
  • uses the sub-processors listed in its privacy policy (hosting, database, sending emails, anti-bot, anti-abuse, payment) and informs you of any change, which you can refuse by cancelling;
  • helps you answer requests to exercise data rights and notifies you without delay of a data breach;
  • at the end of the contract, deletes this data or returns it to you, as you choose;
  • makes available to you the information needed to demonstrate compliance with these obligations.

10. Domain name

The domain name offered with the yearly plan is registered in your name: you are its holder. CrushCode pays for its renewal as long as the yearly subscription is active. At the end of the contract, we give you on request what is needed to transfer it to the registrar of your choice; its renewal is then at your expense.

11. Intellectual property

Your texts, images and logos remain yours. CrushCode's templates, code and design remain the property of CrushCode, which grants you the right to use them for your site for the length of the subscription. The source code is not transferred, unless agreed in writing (custom work).

12. Term, renewal and cancellation

The monthly subscription has no minimum term: it renews every month until it is cancelled. The yearly subscription is concluded for twelve months and renews for successive twelve-month periods unless cancelled. You can cancel at any time, free of charge, from the “Billing” page of your client area, with the “Cancel your contract” feature; cancellation takes effect at the end of the current period, and a period already started is not refunded, except in case of withdrawal. If you are a consumer, we inform you in writing, no earlier than three months and no later than one month before the end of a yearly period, that you may choose not to renew your subscription (article L. 215-1 of the French Consumer Code).

13. Deleting your account

Deleting your account from your client area cancels your subscription immediately, without refunding the current period, and erases your account, your request, your site's content and the messages it received, except what the law requires us to keep (invoices). Your site is then taken off the web.

14. End of the contract

At the end of the contract, whatever the cause, your site is taken off the web within 30 days. Before that, you can ask us for a copy of your texts and images.

15. Failed payment

If a payment fails, Stripe notifies you and tries the payment again for 14 days; your client area invites you to update your card. Without payment at the end of these 14 days, the subscription is cancelled and article 14 applies.

16. Right of withdrawal (consumers)

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period expires fourteen days after the day the contract was concluded.

To exercise the right of withdrawal, you must inform us (CrushCode, ccrushcode@gmail.com) of your decision to withdraw from this contract by an unequivocal statement (for example, a letter sent by post or an email). You may use the model withdrawal form, but it is not obligatory.

You can also exercise your right of withdrawal online at https://crushcode.fr/en/retractation. If you use this online feature, we will send you, without delay, an acknowledgement of receipt of your withdrawal on a durable medium (for example, by email), including its content and the date and time it was submitted.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

If you withdraw from this contract, we will reimburse all payments received from you without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you expressly agree otherwise; in any event, you will not incur any fees as a result of the reimbursement.

If you requested to begin the performance of services during the withdrawal period, you will pay us an amount proportionate to what has been provided until you informed us of your withdrawal from this contract, in comparison with the full coverage of the contract.

Setting up your site is a service fully performed once the site is online. If, before payment, you expressly requested its immediate performance and acknowledged that you would lose your right of withdrawal once the site is online, you can no longer withdraw from the setup once your site is online (article L. 221-28, 1°). The subscription remains open to withdrawal during the period, subject to payment for the service provided up to the withdrawal.

Address of consumer(s):

17. Legal guarantee of conformity (consumers)

The consumer is entitled to have the legal guarantee of conformity applied if a lack of conformity appears during a period of one month for the monthly plan, twelve months for the yearly plan, and in any case the whole length of the subscription, from the supply of the digital content or digital service. During this period, the consumer only needs to establish the existence of the lack of conformity, not the date on which it appeared.

The legal guarantee of conformity entails the obligation to provide all the updates needed to keep the digital content or digital service in conformity for one month for the monthly plan, twelve months for the yearly plan, and in any case the whole length of the subscription.

The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following their request, free of charge and without major inconvenience to them.

The consumer may obtain a price reduction while keeping the digital content or digital service, or may end the contract and be fully reimbursed in exchange for giving up the digital content or digital service, if:

  • 1° The trader refuses to bring the digital content or digital service into conformity;
  • 2° Bringing the digital content or digital service into conformity is unjustifiably delayed;
  • 3° The digital content or digital service cannot be brought into conformity without costs being imposed on the consumer;
  • 4° Bringing the digital content or digital service into conformity causes major inconvenience to the consumer;
  • 5° The lack of conformity of the digital content or digital service persists despite the trader's unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a price reduction or to the termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to first ask for the digital content or digital service to be brought into conformity.

Where the lack of conformity is minor, the consumer is entitled to cancel the contract only if the contract does not provide for the payment of a price.

Any period during which the digital content or digital service is unavailable while it is being brought back into conformity suspends the remaining guarantee period until the digital content or digital service is supplied in conformity again.

These rights result from articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code. A trader who obstructs in bad faith the application of the legal guarantee of conformity incurs a civil fine of up to €300,000, which may be raised to 10% of average annual turnover (article L. 242-18-1 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund in exchange for giving up the digital content or digital service.

18. Liability

Professional customers: our liability is limited to the amount paid over the last twelve months and does not cover indirect losses (loss of revenue, customers or data). Consumers: we are liable for damage caused by a breach of our obligations under ordinary law; no clause of these terms limits that right.

If the service is interrupted, we restore it as soon as possible.

19. Professional customers: payment and late payment

Amounts are payable when ordering. For a professional customer, any late payment automatically incurs penalties at the rate applied by the European Central Bank to its most recent refinancing operation plus 10 percentage points, and a fixed indemnity for recovery costs of €40 (articles L. 441-10 and D. 441-5 of the French Commercial Code).

20. Changes to these terms

We may change these terms. A change that affects your subscription is announced to you by email at least 30 days before it takes effect; you can cancel free of charge before that date.

21. Governing law

These terms are governed by French law. If you are a consumer, you may bring proceedings, at your choice, before the court of the place where you lived when the contract was concluded or when the harmful event occurred, or before any other competent court.
